Privacy Policy

We at Swishboom, LLC care deeply about your privacy and the privacy of your children. Because we provide a marketplace for care seekers and caregivers to exchange details about childcare, we take our obligations very seriously. This Privacy Policy governs the manner in which we collect, use, maintain and disclose information collected from our Users of the App and our website (together, collectively, the “Services”).

By accessing, using, and/or downloading the SWISHBOOM mobile application and any materials or contents from the App, you acknowledge and agree to this Privacy Policy and agree to the Terms of Use located at: www.Swishboomsitters.com. We may share information among our subsidiaries or sites that SWISHBOOM owns or controls, but such sharing of information is always governed under the terms of this Privacy Policy. If you do not agree with the Privacy Policy or the Terms of Use, you may not use the App. Capitalized terms used in this Privacy Policy have the definition set out in the Terms of Use.

User Data

Collection of Personal Information about and from Minors

We recognize that the nature of our business requires that we come into contact with the Personal Information of children under the age of 18. We classify underage participation in the App in two main categories:

  • Teen Users – Caregivers who are between the ages of 13 and 18
  • Care Receivers – the children of Care Seekers who will be cared for by the Caregivers

Information we Collect about Care Receivers

We collect information about Care Receivers only with the consent of the Care Seeker, when the Care Seeker is in a place of legal authority to provide it, meaning that only parents and legal guardians may provide us information about Care Receivers. Even then, our collection of Personal Information about Care Receivers is extremely limited to the minimum required for the Services to function as intended. We collect:

  • Names of the children
  • Birthday (we do not display the birthday, this is to provide the general ages of the children to potential Caregivers)
  • Photos (completely optional at the discretion of the parent/legal guardian)
  • Critical Information – parents and legal guardians have the option of labeling one or more children with critical information relevant to the search for Caregivers, such as special needs, in order to narrow down eligible Caregivers to those able to provide for children with such needs.

All information we collect about Care Receivers can be deleted at will by the Care Seeker User of the App.

Information We Collect about Teen Users

It is a time-honored tradition that older children make some pocket money to care for younger children near them. We help bring this tradition into the modern era by connecting Teen Users to Care Seekers who are connected with their own friends and family (the “Network”). We do not share the Personal Information of Teen Users outside of their immediate Network.

We limit the collection of information about Teen Users to that which is completely necessary for the Services to function as intended. We require Teen Users (with parental consent as detailed below) to provide for us:

  • Their name
  • Their location (so we can limit the Appointments that show up in their Network to those in their range)
  • Their email address
  • Their age (so we can verify that they are old enough, but also match them with age-appropriate Appointments)
  • Three (3) photos of themselves to help convey identity for jobs

We collect most Teen User information directly from the Teen User, however, a Teen User may be invited to the App by a Care Seeker who has hired them before and wishes to add them to their Network. When a Care Seeker provides us with the information necessary to generate an invite (a phone number), that invite is automatically generated. We do not store that phone number in a reachable format – it is used to send the message and discarded.

When a Teen User provides us with their personal information, we take all reasonable steps to ensure they are providing it with their parent or legal guardian’s consent. This may include separate contact made with the parents or guardian, and/or the creation of a connected parent account.

Personal Information We Collect from Adult Users

SWISHBOOM collects certain information which could be used alone or together to identify you as an individual which includes to your name, mailing address, phone number, email address, cookies, IP logs, and other information that you provide to become a User of the App such as your background, experience, course work, abilities, or personal recommendations (collectively “Personal Information”). When you subscribe or register with the App, we will also collect payment information which is necessary to complete your registration and/or to issue or collect payments for caregiver services. If you fill out a Contact Us form or email us, we will use that information to respond to your request. Your Personal Information will not be distributed or shared with third parties unless it is to transact such business as you have contracted SWISHBOOM to do, to comply with any legal processes and/or law enforcement requests, or in order to conduct any business as SWISHBOOM, in its sole subjective discretion, deems reasonable.

Signing in with Facebook

SWISHBOOM allows Users (Teen and otherwise) to connect to the App through FACEBOOK®’s API when you register for the App or after you have registered for the App. If you connect to the App through FACEBOOK®, we will collect, store and use any and all information you agreed FACEBOOK® could make accessible or provide to the App through its API in accordance with this Privacy Policy. Your agreement (and our access to your information) occurs when you register or access the App through FACEBOOK®.

Technical Data Collected

SWISHBOOM collects and stores some technical information automatically and in the aggregate. SWISHBOOM uses the information that we collect to provide and maintain the App. When you visit the Site or the App, we will store some or all of the following: your location (see below), your IP address, and the browser and operating system used. This information is used to measure the number of visitors to the various sections of the App and identify system performance. SWISHBOOM also uses certain trust web metrics services to track activity on the Site and in the App. SWISHBOOM uses this information to help it develop the App, analyze patterns of usage, and to make the App more useful. This information is not used for associating search terms or patterns of site navigation with individual users. The App is not presently configured to support Do Not Track (“DNT”) signals from web browsers.

SWISHBOOM also uses app session tracking and user behavior metrics services to track activity on the App. SWISHBOOM uses this information to help it develop the App, analyze patterns of usage, and to make the App more useful. We may record swap movement, page scrolling and taps inside the app. No inputs or sensitive fields are recorded, including but limited to, password fields, financial data, first or last name for parents or children, ages, or addresses of any kind. This information is used for aggregated and statistic reporting and not shared with any third party.

Location Data

We collect data directly from your location services on your device to help located and limit available Appointments to those in your immediate vicinity. You can control what your radius is using the App’s settings. You can turn off location services using your device permissions settings at any time, but please be advised this may keep the App from working correct or at all. We do not use your location data for any reason except to provide you the Services and for our own internal business purposes. We never share your location data.

Cookies

SWISHBOOM uses Persistent Cookies to gain aggregate metrics on site usage to understand how people are using the site and how we can make it better. You may have software on your device that will allow you to decline or deactivate Internet cookies, but if you do so, some features of the App may not work properly for you. For instructions on how to remove cookies from your device, go to your browser options for detailed instructions. In addition, further information regarding cookies may be available on other Apps or from your Internet service or browser provider.

Our Use of Personal Information

We do not sell your Personal Information. We use everything we collect to either:

  • Provide you the Services
  • Conduct our ordinary business operations (like payment, branding, pricing, and analysis)
  • Market our products to you
  • For particular reasons set out below

Compliance with Laws or Law Enforcement

  • We cooperate with government and law enforcement officials to enforce and comply with the law. In the event of a claim and/or legal process (including but not limited to subpoenas), to protect the property and rights of the App or a third party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to pose a risk of being illegal, unethical, inappropriate or legally actionable, we reserve the right to disclose any information about you to government or law enforcement officials as we in our sole discretion find necessary or appropriate. We will not release Personal Information to a private party who is seeking legal relief without being required to by a competent court of justice or law enforcement.

Business Transfers

In the event of a merger, acquisition, bankruptcy, reorganization, or sale of a portion or all assets, we may sell, transfer or otherwise share some or all of its assets, and your Personal Information may be transferred as part of that transaction.

App & Site Security

Please note that data transported over an open network, such as the Internet or e-mail, may be accessible to anybody. we cannot guarantee the confidentiality of any communication or material transmitted via such open networks. SWISHBOOM does not accept any liability for direct or indirect losses as regards the security of your Personal Information or data during its transfer via Internet. Please use other means of communication if you think this is necessary or prudent for security reasons.

Our Security Measures

For network security purposes and to ensure that our App remains available to all users, SWISHBOOM employs commercial software programs to monitor network traffic and attempt to identify unauthorized attempts to upload or change information, or otherwise cause damage. All payment information is transmitted via Secure Socket Layer (SSL) technology, encrypted into our payment gateway, and accessible only by those authorized with special access rights to such systems who are required to keep the information confidential. Your user accounts are also protected by the password you use to access your online account with SWISHBOOM, and we urge you to take steps to keep your password safe. If you feel your password has been compromised, you should change it immediately by logging into your account and visiting the “My Account” section. After you have finished using our Site, you should log out of your Swishboom.com account and exit your browser.


Information you expressly authorize us to collect

We may from time to time request permission to collect certain information from or about you. For example, if you use a Swishboom mobile application, we may request permission to access information about the contacts listed in your mobile device phone book when you initiate an address book search for friends who have downloaded the application. This contact information is stored within our Firebase account. We may also request permission to access and store your location (e.g., your precise GPS-based functionality on the mobile devices used to access the Site and Services). If you grant your permission, we will access and/or store such information unless you subsequently opt out by adjusting the settings in your mobile device. This information is stored in Firebase.

Information you provide to us

We collect information you provide directly to us. For example, we may collect information you provide when you create an account, create or edit your profile, upload content or comments, complete a registration, fill out a form or survey, participate in a contest or promotion, make a purchase, subscribe to the Service, pay for or accept payment for services, participate in interactive features of the Service, connect or communicate with us via third party social media sites, send us an email, request customer support or otherwise communicate with us or communicate with other users through the Service. The types of information we may collect in this manner include basic contact information (e.g. name, email address, postal address, zip code, mobile number), location, demographic information, photographs, video, and contact information of references. This information is stored in Firebase.

Your Rights to Your User Data

Changing or Removing your Personal Information

If the personal information you provided when you registered changes, you may update this information by logging into your account and accessing your account settings. If you would like to remove some of the personal information you have posted on the App, such as information you posted in profiles and job postings, you may do so by editing or deleting that item in your My Account area. In some cases, we may not be able to reasonably accommodate your request to remove your personal information, in which case we will let you know if we are unable to do so and why.

Deleting any Personal Information We Have about You

A request to delete your account is different from a request to unsubscribe from emails and communications. If you wish for us to fully delete your account, and with it all collected instances of your Personal Information, please contact us at support@swishboom.com. We can delete as much or as little of your Personal Information as you would like, but please be aware that some data may linger in backups until those backups are overwritten.

Opt-Out of Marketing

We will use your Personal Information to communicate with you about product updates and other interesting business opportunities we think would benefit you. You are free to opt out of such communications by using the link at the bottom of every email. We do not send marketing emails to Teen Users under the age of 16 unless they expressly opt-in.

External Site Links

The App may link to web sites created and maintained by public and private organizations which may include or offer third party products or services. When you access a linked site, you may be disclosing private information. It is your responsibility to keep such information private and confidential. These third-party sites have separate and independent privacy policies. SWISHBOOM does not control or guarantee the accuracy, relevance, timeliness, or completeness of information contained on a linked App and does not have responsibility or liability for the content and activities of these linked sites. If you click a link to an outside App, you will leave the App and are subject to the privacy and security policies of the owners/sponsors of the outside App. we cannot authorize the use of copyrighted materials contained in linked Apps. Users must request such authorization from the sponsor of the linked App. SWISHBOOM is not responsible and disclaims any responsibility for transmissions users receive from linked Apps.

Non-US Citizens

The App is hosted in the United States and is only for the use of United States citizens and lawful residents. Use of the App is subject to the exclusive application of United States law in all matters concerning the Apps and/or Services.

Changes to Privacy Policy

we may revise this Privacy Policy from time to time as new features are added to the App or as laws change that may affect our services. When SWISHBOOM makes changes to the Privacy Policy, they are reflected on this page. Any revised Privacy Policy will apply both to information SWISHBOOM already has about you at the time of the change, and any Personal Information submitted or received after the change takes effect. SWISHBOOM strongly recommends that you periodically reread this Privacy Policy, to see if there have been any changes to our policies that may affect you.
